Walmart sells hard liquor only in states whose laws let large retailers hold a spirits license, and even there it depends on the individual store’s license. Walmart does not publish a state-by-state list. In states such as California and Washington, big-box stores can sell spirits on the main sales floor. In Florida, liquor must be sold from a separate, walled-off store. In Texas, state law bars public corporations such as Walmart from owning liquor stores. In the 17 control states, the state controls spirits sales, which usually keeps liquor out of Walmart even when beer and wine are on the shelf. Here is how the rules work and how to check your local store.
Why Walmart liquor sales vary by state
Section 2 of the Twenty-first Amendment to the US Constitution gives each state broad power to regulate alcohol sold within its borders. As a result, every state decides who may sell spirits, where, and under what license. A national chain like Walmart has to follow 50 different rulebooks, and many states also let counties and cities set tighter limits. That is why two Walmart stores a few miles apart can carry very different shelves.
Most states separate beer and wine from spirits. A store may hold a beer and wine license without any right to sell liquor, so seeing beer at your Walmart does not mean you will find vodka or bourbon there.
The four types of state rules
1. Open license states: liquor can be on the main floor
Some states issue general off-sale licenses that cover beer, wine, and spirits for any qualifying retailer. California is the best-known example: a Type 21 off-sale general license covers spirits along with beer and wine, which is why many California grocery stores, drugstores, and big-box stores stock liquor. Washington joined this group after voters approved Initiative 1183 in 2011, which ended the state’s liquor store monopoly. Under I-1183, spirits retail licenses generally go to stores with at least 10,000 square feet of fully enclosed retail space, a threshold most Walmart Supercenters meet, with limited exceptions for former state and contract liquor stores and for underserved trade areas.
2. Separate store states: liquor next door, not in the aisle
Florida requires retailers to sell liquor from a separate store walled off from the rest of the premises. In 2017 the Legislature passed a bill to remove this “liquor wall,” but Governor Rick Scott vetoed it, so the separation rule remains. 3. Ownership restriction states: Texas
Texas law bars publicly held corporations from holding package store permits, the licenses needed to sell spirits at retail. Walmart challenged the rule, but the US Court of Appeals for the Fifth Circuit upheld it in 2019, and the US Supreme Court declined to hear Walmart’s appeal on November 23, 2020. 4. Control states: the state controls spirits
Seventeen states are alcoholic beverage control states: Alabama, Idaho, Iowa, Maine, Michigan, Mississippi, Montana, New Hampshire, North Carolina, Ohio, Oregon, Pennsylvania, Utah, Vermont, Virginia, West Virginia, and Wyoming. Montgomery County, Maryland, also runs its own system.
- Retail control states, such as Pennsylvania, Virginia, North Carolina, New Hampshire, Utah, Alabama, and Oregon, sell spirits through state-run, locally run, or state-appointed agency stores. Walmart stores in these states generally do not stock liquor.
- Wholesale control states, such as Iowa, Maine, Michigan, Mississippi, West Virginia, and Wyoming, control spirits at the wholesale level but let licensed private retailers sell to consumers. Whether a given Walmart carries spirits there depends on its license.
How to check your local Walmart
- Use the Walmart app or website. Set your home store and search for a spirits brand. If spirits do not appear in results for that store, it likely does not carry them.
- Call the store. Ask whether the store, or an attached liquor store, sells spirits, and what hours apply.
- Check your state regulator. Most state alcohol agencies offer an online license lookup that shows what a specific location may sell.
- Bring valid ID. Expect to show ID at checkout; the legal purchase age is 21 in every state.
